This Enduring Power of Attorney allows you to appoint 1 attorney to manage your financial affairs in case you become incapacitated / lack mental capacity to make decisions. This is based on the prescribed form under the Enduring Power of Attorney Ordinance in Hong Kong.
The Donor appoints the Attorney as the true and lawful attorney to do all acts and things and to execute and sign all deeds and documents which he/she considers necessary or advisable in connection with the Donor's financial decisions, including but not limited to:
• opening, closing and using bank accounts and accounts with other financial institutions;
• claiming, receiving and using benefits, pensions and allowances;
• paying the household, care and other bills;
• making or selling investments; and
• buying or selling the home.
The respective medical practitioner and the solicitor will sign and certify the donor's mental capacity and voluntariness.
The attorney in concern will pledge to apply this form to the Registrar of the High Court under the Enduring Powers of Attorney Ordinance (Cap. 501) when the Donor becomes mentally incapable. The attorney will also pledge to use the Donor's property to benefit the persons stated.
This document should be carefully read by the Individual Donor, Attorney, Registered Medical Practitioner and Solicitor.
The form should be completed when the Donor is mentally capable and fully understand the legal document. The Donor must carefully read the "information you must read" section before progressing to complete the form.
Part A of the form will be completed and signed by the Donor. Part B will be completed and signed by the Attorney. The Registered Medical Practitioner and the Solicitor will certify the form.
All parties should sign and return a copy, and once signed, both parties should get a copy. To avoid any future disputes, both parties may wish to have their signatures witnessed.
The Identity of the Donor, Attorney, Medical Practitioner and Solicitor should all be clearly stated in the Enduring Power of Attorney.
