THIS SETTLEMENT AGREEMENT is made on the day of AGREEMENT_DATE.

BETWEEN

(1)               PARTY_1_NAME of PARTY_1_ADDRESS_SINGLE_LINE ("Claimant") and

(2)               PARTY_2_NAME of PARTY_2_ADDRESS_SINGLE_LINE ("Defendant")

 

WHEREAS 

(A)       The Claimant has filed a claim against the Defendant with the COURT_NAME  under CLAIM_NUMBER ("Claim").

(B)       The parties are desirous of settling the matter referred to in this Settlement Agreement amicably in the following terms and conditions.

 

THE PARTIES HAVE AGREED AS FOLLOWS:-

1.                  In consideration of the premises that the Defendant shall pay the sum of $ SETTLEMENT_AMOUNT and the performance by the Claimant on the terms and conditions provided herein below, the parties shall settle the Claim in the manner stated below. 

2.                  The Defendant shall deliver a lawyers’ cheque or cashiers’ order in the amount of $ SETTLEMENT_AMOUNT to the Claimant by SETTLEMENT_DATE as full and final settlement to the Claim. 

3.                  The Claimant shall at his costs and expenses :

(i)                 adjourn the hearing of the Claim before the COURT_NAME on COURT_HEARING_DATE to a date to be fixed with no order as to costs;
