This Separation Agreement ("Agreement")  is made on 02 May 2024

 

BETWEEN:

(1)    PARTY_1_NAME (“Wife”) residing at PARTY_1_ADDRESS_SINGLE_LINE; and

 

(2)    PARTY_2_NAME (“Husband”) residing at PARTY_2_ADDRESS_SINGLE_LINE

 Background:

(A) On MARRIAGE_DATE, the Husband and Wife were lawfully married at the MARRIAGE_REGISTRY_NAME_AND_PLACE. Both Parties have cohabited at COHABITATION_ADDRESS ("Cohabitation Property")

(B) The Parties acknowledge and agree that their marriage has broken down irretrievably.

(C) The parties agree to separate with the intention to live apart in accordance with the terms and conditions of the Agreement. 

(D) There have been no previous proceedings in any court in JURISDICTION_STATE or elsewhere with reference to the marriage or to any child of the parties. The parties wish to enter into this Agreement to settle all matters relating to property, child custody, child support and spousal support;

(C) Unless otherwise agreed by the parties, this Agreement may be incorporated into a final decree of divorce.

NOW THEREFORE, the parties freely and fully accept the provisions, terms and conditions hereof and in consideration of the promises and mutual covenants herein contained as well as for other good and valuable considerations not herein specifically set forth, the parties do hereby agree to the following:

1. Separation

1.1 The parties to the marriage will separate on SEPARATION_DATE with the intention to live separate and apart from each other.

1.2 Each party may reside in such place or places as he or she may select unless otherwise stated herein. 

1.3 Neither Party will attend the other's living space or work without invitation or approval.
