THIS Listing Agreement (“Agreement”) is entered into on 22 November 2024
Between
(1) PARTY_1_NAME whose principal place of business is at PARTY_1_ADDRESS_SINGLE_LINE (the "Owner")
(2) PARTY_2_NAME whose principal place of business is at PARTY_2_ADDRESS_SINGLE_LINE (the "Broker")
The Owner hereby intends to grant to the Broker for a term from the date hereof, and expiring EXPIRY_DATE, the sole and exclusive right to lease and to receipt for deposit in connection therewith on the following described property located at DESCRIPTION (the “Property”).
Lease Terms
As consideration for the Broker having listed this Property and endeavouring to lease it, a brokerage fee (the “Leasing Commission”) shall be paid by the Owner in accordance with the Commission Schedule below under the following conditions:
When Broker procures a lease on terms set forth in this Agreement, or other terms acceptable to Owner, or if Owner directly or through another person or entity leases the Property, a Leasing Commission shall be paid by Owner in accordance with the Commission Schedule herein below. In the event Owner enters into a Lease Agreement within six (6) months after the expiration of this listing with any person or entity who during the term of this listing received information on this Property either directly or through the offices of the Broker, a Leasing Commission shall be paid by Owner in accordance with the Commission Schedule below
Commission Schedule:
1. Leasing Commission
The Leasing Commission shall be the amount calculated at a rate of COMMISSION of the total gross rentals due pursuant to the initial lease term (the “Standard Leasing Commission”), except, in the event, a broker, other than Broker, procures the Tenant (the “Tenant Procuring Broker”), in which case the Leasing Commission shall be the greater of the Standard Leasing Commission or the gross sum of the amount calculated at a rate of TENANT_PROCURING_BROKER of the total gross rentals due pursuant to the initial lease term (the “Listing Broker Commission”) plus the amount calculated at a rate of one dollar per rentable square foot per year of the initial lease term (the “Tenant Procuring Bonus Commission”).
