COMMUNITY GARDEN LEASE

THIS IS A COMMUNITY GARDEN LEASE (the “Lease”), dated as of _________, 20___, between [ Name of Landowner ], (“Landowner”) and [ Name of Client ], a [ Jurisdiction ] nonprofit corporation (“Client”).

BACKGROUND

Client is a nonprofit organisation whose mission is [ describe mission briefly ]. In line with its mission, Client wishes to develop and operate a community garden. Landowner is wiling to lease land to Client for that purpose on the terms described in this Lease.

LANDOWNER AND CLIENT AGREE AS FOLLOWS:

1. PARCEL, TERM AND RENT

1.1 Lease. Landowner leases to Client the [ ____ ]-square foot parcel located at __________(the “Parcel”). [ Either describe location of parcel or include as an exhibit. ]

1.2 Use. Client will use the Parcel for the sole purpose of operating a community garden (the “Garden”) with plots to be licensed by Client to community members.

1.3 Term. The term of this Lease is [ X ] year(s), starting on [ __________, 20___ ] and ending on [ __________, 20__ ]. This Lease will terminate upon the expiration of this term or the final renewal term, if any, or if either party terminates it as described in Section 4.

1.4 Renewal. This Lease will automatically renew for additional ___-year terms unless either Landlord or Client provides written notice to the other of non-renewal no later than [ three ] months prior to the end of the current term.

1.5 Rent. On the date that this Lease is signed and on each following anniversary, Client will pay Landowner $__ in rent for the next year. For each renewal term, Landowner may, in its sole discretion, increase the amount of the annual rent payment by up to ___% by notifying Client within [ three ] months prior to the start of such renewal term.

1.6 Late Payment. Client’s failure to pay rent within five days of when the payment is due breaches this Lease. If that happens, Landowner will have all of the rights and remedies provided for in this Lease and under law in the case of non-payment of rent. In addition, Landowner may charge Client interest on any unpaid rent at the rate of 1% monthly, calculated from the 6th day after payment became due and continuing until paid.
