This Social Media Release (“Release”) is made by and between FULLNAME located at ADDRESS (“I” “Me”) in favor of the name of Social Media Creator ACCOUNT_JOB_COMPANY located at (“Creator”) in connection with my appearance in the following content: ACCOUNT_JOB_COMPANY ("Content"). The Release is made effective on 11 May 2024.
1. In return for the opportunity to appear in the Content and payment of PAY, receipt of which is acknowledged, I irrevocably authorize and grant Creator (and Creator’s successors) the right to photograph and videotape Me for use in the Content and to use my image, name, picture, voice, or other likenesses, (collectively, “Appearance”) in whole or in part, in any and all present and future media for the purposes of advertising, publicity, and exploitation of the Content in perpetuity throughout the Universe. I understand that the Creator has the final discretion on the creative direction of the Content and that my Appearance may not be used in the final published version of the Content.
2. I understand and agree that: (a) the consideration in Section 1 above is the full and complete compensation for use of my Appearance and that I have no other rights to the results and proceeds derived from my Appearance and/or the Content, (b) Creator is the sole owner of all intellectual property rights in the Appearance and the Content, and (c) my Appearance is a “work made for hire” for Creator.
3. I release Creator from all liability, including but not limited to claims concerning copyright, privacy, publicity, and moral rights in connection with the use of my Appearance in the Content.
4. I further indemnify Creator against all claims, liability, and expenses with respect to this Release and understand that Creator is materially relying on this Release in preparing and exploiting the Content.
5. I waive the right to seek any form of injunctive relief and will not interfere with the exploitation of the Content and agree that my sole remedy for a breach of this Release by Creator is to seek direct money damages.
6. Creator may assign this Release to any party, but I understand that this Release is personal to Me and I cannot assign it.
7. I represent that I am an independent contractor and that my Appearance and this Release do not create a joint venture or employment relationship between Me and the Creator.
8. I represent and affirm that I am of legal age and have the right and authority to enter into this Release.
