CONSTRUCTION AGREEMENT
This Construction Agreement (hereinafter referred to as the “Agreement”) is made and entered into on this 01 April 2025, by and between:
NAME, whose principal place of business is at ADDRESS (hereinafter referred to as the "Owner"), and
NAME2, whose principal place of business is at ADDRESS2(hereinafter referred to as the "Contractor").
RECITALS
WHEREAS, the Owner is the owner of a property located at ADDRESSPROPERTY ("Property");
WHEREAS, the Owner wishes to engage the Contractor to perform specific construction services on the Property;
WHEREAS, the Contractor is in the business of providing construction services and agrees to perform such services for the Owner under the terms and conditions outlined in this Agreement.
NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, and for other valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:
1. DEFINITIONS
1.1 Agreement: refers to this Construction Agreement, including all exhibits, schedules, and attachments, as may be amended from time to time.
1.2 Change Order: means a written order signed by both the Owner and the Contractor that authorizes changes to the Work or adjustments to the Contract Price or Contract Time.
1.3 Contract Price: is the total amount the Owner will pay the Contractor for completing the Work.
1.4 Contract Time: is the period within which the Contractor must complete the Work.
1.5 Draw: refers to a payment made by the Owner to the Contractor.
1.6 Force Majeure Event: includes any event beyond the Contractor's control, such as natural disasters, war, civil unrest, or other unforeseen circumstances that prevent the Contractor from performing the Work.
1.7 Owner: is NAMEOWNERand any successors or assigns.
