When it comes to maintaining a comfortable home or business, your HVAC (Heating, Ventilation, and Air Conditioning) system plays a crucial role — it lists out the terms and conditions for companies to follow when they help you make repairs. But what exactly do they cover, and what potential issues do I need to watch out for before signing a contract? In this post, we’ll break down everything you need to know about HVAC service agreements, and provide you with a service contract template that’s ready to use.
An HVAC contract (also called an HVAC service agreement or preventive maintenance contract) is a formal agreement between you and an HVAC company. It typically includes scheduled inspections, tune-ups, and priority service in exchange for a fixed annual or monthly fee.
Routine maintenance can catch small issues before they become expensive repairs. A well-maintained system is also less likely to fail during extreme weather.
HVAC systems are a major investment. Regular upkeep can add years to their operational life, delaying the need for a costly replacement.
Dirty filters, clogged coils, and low refrigerant levels make your system work harder, increasing energy bills. A tuned-up HVAC unit runs more efficiently, saving you money in the long run.
With priority service and discounted repairs, you won’t have to scramble for help during a heatwave or cold snap.
When drafting or reviewing an HVAC contract, pay attention to all of the following:
✅ The Parties’ Names – Clearly state the parties, and include company addresses wherever possible.
✅ Services – What services will the HVAC contract provide? How often will they carry out maintenance inspections? Typically, bi-annual check-ups are implemented for air conditioners and heaters.
✅ Completion Date – What is the deadline for completion of the services? If the HVAC company cannot complete by the required date, can they apply for an extension? How much damages can the customer receive for each day/week that the works are left uncompleted?
✅ Agreement Price – How much will be paid for the services? Is it paid in a lump sum, in monthly installments, or after each check-up?
✅ Defects Liability – The HVAC provider typically has a responsibility to correct their own defects and mistakes. How long is the warranty period for this?
✅ Personal Injury and Damages – Who will bear the responsibility if an accident happens while the maintenance works are being carried out?
✅ Termination – Typically, there will be terms about how the contract can be ended prematurely. This can happen if either party becomes bankrupt, or the customer is unsatisfied with the service (though different HVAC plans may vary). Here, the contract will state how the remaining payments will be settled.
✅ Signatures – Both parties should read the contract carefully, and after that, sign the contract in the signature blocks provided.
✅ Date – The date is a crucial part of the contract, and is required for it to become enforceable.
