Document Description

Affidavit/Affirmation of service is the document filed by the Plaintiff or the Plaintiff's agent in relation to the service of the writ of summons or originating summons to the Defendant. 

An Affidavit/Affirmation of service is a written statement of fact which is voluntarily made. The Plaintiff/ Plaintiff's agent claims to be duly authorised to make the affirmation that they served specific documents. The sworn Affidavit/Affirmation of service is to be submitted to the court as evidence to prove that the writ of summons or originating summons is served. 

 

How to use this Document?

The Document shall be carefully read and drafted by the Plaintiff/Plaintiff's agent.

This affidavit format may be used by the Plaintiff to draft an affirmation/affidavit in support of service of documents

This document may be used when there is a need to affirm a statement made by the Plaintiff is of truth to his or her knowledge
