This document can be used to draft A Notice to Insurer.
This is intended for Plaintiffs (employee) who were injured in the course of employment and intend to seek damages against two parties, namely the employer and the principal contractor. Hence, commencing personal injuries litigation.
The Insurer is to take notice that the Plaintiff has commenced action in the District against the Defendants for damages for personal injuries caused to the Plaintiff by reason of negligence and/ breach of statutory duties and/or breach of implied terms of the employment contract and/or breach of employer's duty of care under the Occupiers Liability Ordinance, Cap.314 of Hong Kong law.
A sealed copy of the Writ of Summons is also included with the document.
This document should be carefully read by the individual Plaintiff and Defendant.
The time of the accident or injury caused to the plaintiff whilst the said defendant was insured by the insurer should be clearly stated in the Notice to insurer.
This Notice to insurer is to be filed when a Plaintiff commences proceedings against the Defendant and to give notice of action to the insurers.
