Document Description

Confirmation of fulfilment / waiver of conditions / conditions precedent by one party to another party under an agreement.

A notice of fulfilment / waiver of conditions is used to legally proclaim the terms of an agreement have been fulfilled / relinquished. It is often required in a real estate sales agreement to proceed to transaction.

Care needs to be taken to terming fulfilment and waiver. Confirmation of fulfilment is a promise that the agreed terms have been performed fully as stated. On the other hand, confirmation of waiver is a relinquishment on the agreed terms.

The document first directs the attention to the previously made agreement. The agreement date, counterparty name, account company, and the purpose of the agreement are all clearly stated. Within the agreement, a particular clause is proclaimed to have been fulfilled / waived.
