In relation to a lease / tenancy /rental, the Landlord seeks refund of agency fee from agent on a pro rata basis from tenant's early termination of the agreement.
The Tenant signed up to a term but has only rented for [x] months until termination. The Landlord has only received rent until date and has already paid the agent month of agency fee. In addition, the Landlord has also miss the golden period of summer holiday when there are most tenants available.
Essentially, the tenant has breached the term tenancy agreement. The period is for [x] year and there is no ground for the tenant to terminate early.
As the Tenant was introduced by the agent, the Landlord demand a refund of the agency fee the Landlord paid to the Agent on a pro rata basis to reflect the number of months the Tenant actually rented the property.
