This is a Service Agreement suitable for disc jockey services. Under this agreement, a DJ Company offers disc jockey services to a Customer at an Agreed Price. This agreement is drafted in favour of the Customer.
The Parties under this agreement agree that the Services, as prescribed, shall be carried out following and subject to this Agreement hereto.
The DJ shall provide the Services with the best and commercially reasonable efforts and a high professional standard to the Customer.
The DJ shall comply with and give all notices required by any statute, statutory instrument, rule or order, or regulation or bylaws applicable to the Work.
This version imposes onerous, unilateral confidentiality obligations on the DJ. It also demands that the DJ pay a late cancellation fee should the DJ cancel performance of the obligations less than 5 days before the agreed date for performance of the Services.
This Agreement also obliges the DJ Company to conduct background searches on all its DJs to ensure they do not have any criminal history and are not listed on any sex offender registry.
Both the DJ's and Customer's information should be provided in this agreement, along with their principal place of business.
The agreed price and completion date should also be specified and the type(s) of services to be provided by the DJ.
Both Parties should also provide the agreed Services, Price and time of completion/payment in the agreement. If any, it may specify amount of damages per week the Customer is entitled to if the Work is not completed by the completion date.
It does not feature any limitation of liability clause in favour of the DJ (unlike the neutral version).
